Supreme Court to review Tenth Circuit Court ruling on SREs


The U.S. Supreme Court announced on Jan. 8 it will review a Jan. 24, 2020 ruling by the Tenth Circuit Court of Appeals that, if implemented nationally, would reduce the number of obligated parties that are eligible to apply for SREs under the RFS.

IRS issues final rule for 45Q tax credit


The U.S. Treasury Department and the IRS on Jan. 6 issued final regulations regarding the section 45Q tax credit for qualified carbon oxide sequestration. The Carbon Capture Coalition said the rule provides overdue regulatory and financial certainty.

USDA: US ethanol exports at 114 million gallons in November


The U.S. exported 113.62 million gallons of ethanol in November and 927,604 metric tons of distillers grains according to data released by the USDA FAS on Jan. 7. Exports of both products were down when compared to the previous month.

Groups reject EPA’s excuse for failing to comply with court order


On Jan. 7, a coalition of biofuels and ag trade groups filed its reply in support of its November 2020 motion in the U.S. Court of Appeals in the District of Columbia. The motion asks the court to enforce its 2017 decision on improper RFS waivers.

Ingredion confirmed on Jan. 6 it is idling its 45 MMgy ethanol plant in Cedar Rapids, Iowa. A company spokesperson attributed the decision to “current market conditions [that] have impacted the entire ethanol industry.”

EIA: Ethanol production up slightly, stocks down 1%


U.S. ethanol production was up slightly the week ending Jan. 1, according to data released by the U.S. Energy Information Administration on Jan. 6. Weekly ending stocks of fuel ethanol fell by approximately 1 percent.
